1. Background

The Republic of China (Taiwan) lost its UN seat to the People’s Republic of China (PRC) under UN General Assembly Resolution 2758 (1971).

However, the resolution did not address Taiwan’s sovereign status, nor did it determine Taiwan to be part of the PRC.

The legal assessment remains:

Resolution 2758 concerns representation, not sovereignty.

Taiwan’s international legal status remains undetermined.

Misinterpretation of 2758 as “Taiwan = PRC” is widespread even within UN offices.

This is noted as a “persistent internal misunderstanding” by multiple OLA officials.

2. Political Influence

Taiwan’s exclusion from UN bodies is driven not by legal grounds but by continuous political pressure from the PRC.

The PRC, as a permanent member of the Security Council (P5), explicitly applies or threatens:

Veto against any agenda including “Taiwan”

Objection to Taiwan’s observer status

Opposition to Taiwan’s participation in specialized agencies

Therefore, the UN Secretariat is functionally unable to take any official position regarding Taiwan.

3. Historical Clarification

According to the Office of Legal Affairs (OLA) and the Department of Management / Historical Affairs (DMO/HIS) Review (Rev.2 – Aug 2025):

A. Taiwan has never been governed by the People’s Republic of China.

This is historically verified.

Qing-era partial control (17th century–1895) does not constitute modern state governance.

Post-1895: Taiwan was ceded to Japan and administered separately.

Post-1949: Taiwan has maintained self-government, independent military, judiciary, and autonomous institutions.

No historical period exists in which PRC exercised authority over Taiwan.

A. Taiwan meets all criteria of a sovereign state
